The Supreme Court’s unanimous decision that a representative action brought against Google should not proceed ([2021]UKSC 50) is a very positive development for data controllers of all sizes. On 10 November 2021 the UK Supreme Court will had down the long awaited judgment in Lloyd v Google. The Court of Appeal’s decision opened the way to “opt out” collective data breach claims. It has, today, been announced on the UK Supreme Court website that judgment in the case of Lloyd v Google will be handed down at 9.45 on Wednesday 10 November 2021. Google’s appeal against the Court of Appeal’s 2 October 2019 decision ([2019] EWCA Civ 1599) was heard on 28 and 29 April 2021 by a panel consisting of Lord Reed, Lady Arden and Lords Sales, Leggatt and Burrows. One of the more intriguing aspects of the draft Online Safety Bill is the government’s insistence that the safety duties under the draft Bill are not about individual items of content, but about having appropriate systems and processes in place; and that this is protective of freedom of expression.
