Media and Law Cases: 2019 Michaelmas Term Preview

The Michaelmas Legal Term in England and Wales began a week ago, on Tuesday 1 October 2019.  It will end on Friday 20 December 2019. This post deals with the media law cases listed for this term and cases in which decisions are awaited.

On 6 and 7 November 2019 the Supreme Court (Lady Hale and Lords Reed, Kerr, Hodge and Lloyd-Jones) will hear the appeal in the data protection case of W M Morrisons Supermarkets plc v Various ClaimantsWe had a post on the Court of Appeal decision on 21 November 2018.

On 20 or 21 November 2019 the Court of Appeal will hear the appeal in the case of Burki v Seventy Thirty Limited.  We had a post on the first instance decision.

The following trials and applications are listed for this term:

On 14 October 2019 there will be an application in the case of Gabb v Times Newspapers Ltd.

On 15 October 2019 there will be an application in the case of Ager v Career Development Ltd.

On 16 October 2019 there will be a hearing in the case of Feyziyev v The Journalism Development Network Association & anr.  There was a trial of a preliminary issue on meaning in April 2019 ([2019] EWHC 957 (QB))

On 21 October 2019 there will be an application in the case of Triaster Ltd v Dun & Bradstreet Ltd.

On 24 October 2019 there will be an application in the case of Lord Sheikh v Associated Newspapers.

On 29 October 2019 there will be a hearing in the case of Abdulrazaq v Hassan .  This is a claim in libel and malicious falsehood by a litigant in person.  The claim form and particulars of claim are available on Lawtel [£].

On 4 November 2019 there will be an application in the case of James v Saunders.

On 6 November 2019 there will be an application in the case of Chandler v O’Connor.

On 11 November 2019 there will be a trial in the case of Al-Haddad v Telegraph Media Group Ltd.  The case concerns an article in the Sunday Times on 22 December 2013 with the headline “Asbos to silence 25 hate clerics”. The claim form and particulars of claim are available on Lawtel [£].  The trial is listed for 3 days

On 11 November 2019 there will be a trial in the case of Turley v Unite the Union The claimant is the MP for Redcar.  The claim is for data protection, misuse of private information and libel. The claim form and particulars of claim are available on Lawtel [£].  The trial is listed for 5 days.

On 26 November 2019 there will be an application in the case of Kirkegaard v Smith.

On 5 December 2019 there will be a hearing in the case of Triplark v Northwood Hall & Ors.

On 12 December 2019 there will be a trial in case of Onwude v Dyer & Ors.  The claim is by a litigant in person in relation to an article in the BMJ on 22 December 2016. The claim form and particulars of claim are available on Lawtel [£].  The trial is listed for 3 days

The following cases are awaiting permission to appeal decisions from the Court of Appeal:

Wright v Ver

Bull v Desporte

Alsaifi v Secretary of State for Education

Caine v Advertiser and Times Ltd

Cases which are presently before the appeal courts and will be heard in 2020 include: ZXC v Bloomberg (listed in the Court of Appeal for 3 or 4 March 2020) and Serafin v Malkiewicz (awaiting hearing the Supreme Court, see here)
