Royal-Courts-of-JusticeThe Court of Appeal has given permission to appeal to each of the three defendants against the decision of Warby J in the case of Lachaux v Independent Print ([2015] EWHC 2242 (QB)).

Judgment was handed down on 30 July 2015. The Judge held that the claimant had established “serious harm to reputation” under section 1 of the Defamation Act 2013 in relation to publications in the Independent, the Evening Standard and the Huffington Post.  We had a case comment at the time.

Permission to appeal was refused by the judge on 21 October 2015.  All three defendants sought permission to appeal from the Court of Appeal and, on 11 January 2016, they were all granted permission on paper by the single judge.  The “hear by” date is presently 13 February 2017.
