Two high-profile celebrity libel cases have recently ended with a substantial financial settlement in the Claimant’s favour: undisclosed, following a ruling on meaning and liability, in the case of Sally Bercow and Lord McAlpine; and a £125,000 damages payment in the case of the “Celebrity Psychic” Sally Morgan versus the Daily Mail, reached privately with the matter already due for trial. On 22 June 2013 the Independent published a genuine scoop – ‘The Other Hacking Scandal‘ (here). Tom Harper obtained and reported on the full and unredacted version of the 2008 Serious Organised Crime Agency (SOCA) report on ‘Project Riverside’. It collated and detailed five investigations uncovering serious illegalities by ‘rogue element’ private investigators. The Indy’s scoop triggered a chain reaction amongst some of Harper’s fellow journalists seeking to blame Leveson for keeping them in the dark. Continue reading
On 20 May 2013, the Court of Appeal handed down judgment in AAA v Associated Newspapers ([2013] EWCA Civ 554). It held that the Claimant, a child, did not have her rights under Article 8 breached by an article in the Daily Mail which speculated that her father was Mayor of London, Boris Johnson. The Judgment raises interesting questions as to the extent to which the behaviour of a child’s parent affects the former’s expectation of privacy. Continue reading
The Court of Appeal, Criminal Division, dismissed appeals by five former News of the World employees against a preliminary ruling that interception of read voicemails constitutes an offence under RIPA. The appellants’ anonymity was removed and the appeal route to the Supreme Court was closed off. All five now face trial on 9 September 2013.
