Media injunctions: appeal against injunction refused in Weller case – Iona Millership

PaparazziIn Weller and others v Associated Newspapers Limited, ([2015] EWCA Civ 1176) the Court of Appeal has rejected an appeal by Associated Newspapers Limited, publishers of the Mail Online website, against a finding of liability in the tort of misuse of private information arising from the unauthorised publication of unpixelated paparazzi photographs of Paul Weller’s children taken on a family outing, which were originally published by the Mail Online in October 2012, and an injunction preventing re-publication of the same. Cheshire-West-and-Chester-CouncilIn Cheshire West and Chester Council and others v Pickthall, [2015] EWHC 2141 (QB) Mr Justice Edis granted an interim injunction under the Protection from Harassment Act 1997 (the “PHA”) to restrain the defendant from publishing allegations of criminal conduct on the part of the claimant Council and various individuals associated with it.  In doing so, he showed the balance between freedom of expression and protection from harassment at the interim stage. Case Law: Twentieth Century Fox v Sky UK, Blocking injunction granted in relation to “Popcorn time” websites – Kana Patsalides
