Case Law, Strasbourg: Eon v France, Satirical insult of head of state should not be a criminal offence – Rosalind English

PRS AUTOCEon v France, no. 26118/10   14 March 2013- read judgment (in French only).  The applicant, Hervé Eon, is a French national, a socialist and anti-GM activist living Laval (France). The case concerned his conviction for insulting President Sarkozy.

During a visit by the President to the département of Mayenne on 28 August 2008, Mr Eon had waved a placard reading “Casse toi pov’con” (“Get lost, you sad prick”), a phrase uttered by the President himself several months previously when a farmer had refused to shake his hand at the International Agricultural Show. The utterance was widely disseminated in the media and on the internet, attaining the status of a slogan. Case Law: Tesla Motors v BBC, Top Gear up before Top Judges – Rosalind English

Top GearIn the case of Tesla Motors v BBC ([2013] EWCA Civ 152) the Court of Appeal refused an appeal against the strike out of a libel claim against the BBC in relation to a review of an electric sports car by the “Top Gear” programme. The judge below had been correct in concluding that there was no sufficient prospect of the manufacturer recovering a substantial sum of damages such as to justify continuing the case to trial. Case Law: Bristol City Council v C, Identity of social workers may be published following fostering bungle – Rosalind English

question-mark-faceThe case of Bristol City Council v C and others ([2012] EWHC 3748 (Fam)) was an application for a reporting restriction order arising out of care proceedings conducted before the Bristol Family Proceedings Court. The proceedings themselves were relatively straightforward but, in the course of the hearing, information came to light which gave rise to concerns of an “unusual nature”, which alerted the interest of the press.
