It appears that the press have learned nothing after the Daily Mail lost the Paul Weller appeal last November ([2015] EWCA Civ 1176). Whilst that case involved the photographing of children, the Court of Appeal reasserted the five criteria to be considered as to whether the use of a photograph breaches an individual’s Article 8 rights. The Sun illustrated its front page report on the England football team’s humiliating defeat at the hands of Iceland with a photograph of Wayne Rooney’s 6 year old son, Kai, in tears. Several other pictures of Kai at the match appeared in Sun Online. Continue reading
The Supreme Court has refused Associated Newspapers Limited permission to appeal against the decision awarding damages and an injunction to the three children of the singer Paul Weller following the publication in the Daily Mail of photographs of them taken in public places in California. On 20 November 2015, the Master of the Rolls, Tomlinson and Bean LJJ handed down judgment in Weller & Ors v Associated Newspapers Ltd [2015] EWCA Civ 1176, upholding Dingemans J’s finding of liability for misuse of private information (and breach of the DPA, although this did not add anything as it was common ground that the claim for infringement of the DPA would either stand or fall with the claim for misuse of private information). An opinion poll has shown strong public support for a campaign to protect children’s privacy by preventing the media from publishing photographs of children without parental consent. On 16 April 2014, Mr Justice Dingemans in the Queen’s Bench Division handed down judgment in Wellers & Ors v Associated Newspapers Limited [2014] EWHC 1163 (QB), awarding Paul Weller’s three children a total of £10,000 damages for misuse of private information. Continue reading
The singer Paul Weller, acting on behalf of three of his children, was successful in his privacy action against Associated Newspapers Limited (ANL) in relation to seven unpixellated photographs of the children and their father out shopping on a public street and relaxing in a café in Los Angeles. The photographs, in particular, showed the faces of all three children. They were published on Mail Online on 21 October 2012. Continue reading
