What a tragedy it is that it requires another suicide to regenerate widespread interest in cyberbullying, the phenomenon that has become the scourge of the internet age. Charlotte Dawson, the New Zealand–Australian television personality, recently took her own life following a lengthy battle against anonymous Twitter trolls, which has precipitated calls for tougher anti-cyberbullying legislation in Australia (see and sign here). Latest figures show that an increasing number of young children are savvier about the internet than their parents and easily circumvent internet filters that have been put in place by their parents. Baroness Howe’s Online Safety Bill [pdf] goes some way in addressing this problem by proposing to impose compulsory internet filters on all Internet Service Providers (ISPs) and Mobile Phone Operators (MPOs). On 10 October 2103, the European Court of Human Rights handed down judgment in Delfi AS v. Estonia (no.64569/09), a case concerning the liability of a news portal, Delfi AS for third-party comments made on its website. The Estonian courts found that Delfi AS had editorial control over the comments’ section on its news site and should have prevented clearly unlawful comments from being published, notwithstanding the fact that Delfi had taken down the offensive comments immediately upon being notified of them. The Open Rights Group is asking people to sign a petition asking David Cameron not to require Internet Service Providers to switch on ‘adult’ web filters by default, meaning that anyone who wishes to access certain kinds of material online will have to ask their ISP to switch off the filter. And the results show a slight majority (54%) against doing so.
