A couple of men sitting in a chair Description automatically generatedOn 12 October 2023, Mr Justice Jay handed down judgement in Cooper v Evans & Anor [2023] EWHC 2555 (KB) in favour of the defendants. The Judge refused the claimant’s (Mr Andrew Cooper) application for an injunction under the Representation of the People Act 1983 (“the RoPA”), which sought to prevent the republication of a political advert published on West Midlands Labour social media pages regarding the claimant, who was at the time a Conservative candidate for the Tamworth by-election (held on 19 October 2023). Case Law: Aaronson v Stones: Libel Trial, truth and the perils of tacking on a public interest defence – Floyd Alexander-Hunt

On 13 October 2023, Mr Justice Julian Knowles handed down judgement in Aaronson v Stones [2023] EWHC 2399 (KB). The Judge found for the claimant Jack Aaronson, an adult entertainment entrepreneur, in a libel claim against the defendant Marcus Stones, a former adult entertainer, who had published several tweets and featured in a YouTube video alleging the claimant was a serial rapist. Case Law: Blake v Fox: Racist, Paedophile, fact or opinion? – Floyd Alexander-Hunt

On 25 August 2023, the Court of Appeal (Nicola Davies, Arnold and Warby LJJ) handed down judgment in Blake & ors v Fox [2023] EWCA Civ 1000. The Court dismissed an appeal against Nicklin J’s findings in the High Court in respect to the natural and ordinary meaning of five (out of six) tweets regarding accusations of racism and paedophilia ([2022] EWHC 3542 (KB)). This libel case provides useful analysis for distinguishing statements of fact from opinion and is a cautionary reminder against grouping statements together when there are multiple claimants.
