In a new book published by Harvard University Press, “Hate Crimes in Cyber Space” Prof. Danielle Citron lays her prescription for tackling the “awful internet”. In the wake of the Fappening and innumerable cases of cyber harassment, hers is a timely and authoritative intervention. Since Prof. Citron has already testified before Parliament on cyber hate and sits on the influential Anti-Cyberhate Working Group, her book and views are likely to inform future policy and legislation towards the internet. A “15-year-old high school student” who was “prosecuted for ‘cyberbullying’ under a local law enacted by the Albany County Legislature” pleaded guilty to one count of cyberbullying and then challenged his conviction on appeal. People v. Marquan M., 2014 WL 2931482 (Court of Appeals of New York 2014). In his appeal, Marquan M. claimed the statute violated the First Amendment. People v. Marquan M., supra. Continue reading
Scarcely a day goes by without there being a report of someone, somewhere being cyber bullied. Incidences are not limited to celebrities but can, and do, affect anyone and everyone. What a tragedy it is that it requires another suicide to regenerate widespread interest in cyberbullying, the phenomenon that has become the scourge of the internet age. Charlotte Dawson, the New Zealand–Australian television personality, recently took her own life following a lengthy battle against anonymous Twitter trolls, which has precipitated calls for tougher anti-cyberbullying legislation in Australia (see and sign here). Latest figures show that an increasing number of young children are savvier about the internet than their parents and easily circumvent internet filters that have been put in place by their parents. Baroness Howe’s Online Safety Bill [pdf] goes some way in addressing this problem by proposing to impose compulsory internet filters on all Internet Service Providers (ISPs) and Mobile Phone Operators (MPOs).
