The UK Government has promulgated a new definition of extremism. The new definition changes the focus from action to ideology. In 2011, the government’s Prevent strategy defined extremism as the “active opposition to fundamental British values, including democracy, the rule of law, individual liberty and the mutual respect and tolerance of different faiths and beliefs”. On 27 February 2024, judgment on meaning was handed down by Lewis J in the long-running litigation between the Dyson Group companies and the broadcasters Channel 4 and ITN, Dyson Technology Ltd & Anor v Channel Four Television Corporation & Anor [2024] EWHC 400 (KB). Lewis J held that the news item first broadcast on Channel 4 News on 10 February 2022 made defamatory allegations of fact and of opinion. Continue reading

On 1 February 2024, Steyn J dismissed the application to amend the Claim Form and struck out the existing claim in Trump v Orbis Business Intelligence Ltd [2024] EWHC 173 (KB). The Defendant was entitled to summary judgment. Donald Trump filed the claim against Orbis Business Intelligence, a British firm co-founded by Christopher Steele, a former MI6 intelligence officer. On Tuesday 21 November 2023, Counsel for the claimants in Lawrence & Ors v Associated Newspapers Ltd (ANL) told the High Court that they intend to ask ministers for permission to use confidential Leveson Inquiry documents in their legal action against the publisher of the Daily Mail. Earlier this month, Nicklin J ruled that the legal challenges could continue but could not use information drawn from ledgers given by ANL to the Leveson Inquiry into press standards in 2011 and 2012 [2023] EWHC 2789 (KB). On 10 November 2023, Nicklin J dismissed Associated Newspaper Ltd’s (ANL) application for summary judgement against seven claimants bringing misuse of private information proceedings against the publisher of The Daily Mail, The Mail on Sunday, and the MailOnline website, Baroness Lawrence of Clarendon & Ors v Associated Newspapers Ltd [2023] EWHC 2789 (KB). Nicklin J concluded “without difficulty” that each claimant had a real prospect of overcoming any limitation defence relied upon by the publisher. Continue reading

On 16  October 2023, Steyn J will hear applications in the case of Donald Trump v Orbis Business Intelligence.  The former President contends that the so-called “Steele Dossier” produced by the defendant breached his data protection rights.  The defendant has applied to strike out the claim as an abuse of the process.  The New York Times has a full report.  There are also reports in the Guardian and the Independent. On 27 June 2023 the House of Lords approved an amendment to the Economic Crime and Corporate Transparency Bill which aims to tackle “strategic litigation against public participation” (“SLAPPs”); the use of defamation law to silence critics.  The amendment was only published the week before and was not subjected to any consultation, white paper or select committee report.
