Leveson Principles underpinned in 133 words of legislation: no need for an extensive law – Chris Pounder

4Have you followed all the hand wringing by Government about the statutory underpinning of the Leveson Principles? Have you seen the press coverage equating statutory underpinning with state control?  Evidently the Government say there are pages and pages of legislation to draft in order to underpin, in law, an independent self-regulatory body for the Press. Leveson and Legality: implementation of the Report would not be Illegal – Hugh Tomlinson QC [Updated]

Shami ChakrabartiAccording to the “Mail on Sunday” the Leveson assessor and Liberty Director Shami Chakrabarti has “delivered the bombshell verdict that his demand for compulsory press regulation would be illegal”.  The BBC has, in turn, reported the story under the headline “Leveson report proposals ‘would be illegal‘”.  This is distortion of Ms Chakrabarti’s views which, as is clear from the report, relate to matters which do not form part of its recommendations.  In any event, Ms Chakrabarti’s analysis is wrong in law.  The suggestions made in the report to which she refers are lawful and in no way inconsistent with the Human Rights Act 1998. The result of over a year of gathering evidence; analyzing the situation and critiquing possible ways forward. The conclusion – a system of independent self-regulation backed by law. A solution that offers a means by which the industry can continue to inform and advise the criteria on which they are judged (through a Code Committee) without doing the actual judging themselves (this would be the job of the independent regulatory body). News: Northern Ireland Court Orders Facebook to take down “Paedophile Watch” page

FacebookThe Northern Ireland High Court has ordered Facebook to take down a page entitled “Keeping our kids safe from predators” on an application made by a convicted sex offender. The claimant, who was anonymised and known only as XY, was given a six year jail sentence for a child sex offence more than 20 years ago.  He claimed that material published on the page constituted  harassment, breach of privacy, and misuse of his private information.
