On 28 October 2014. Mr Justice Mann, the judge managing the Mirror Group phone hacking litigation, handed down a judgment dealing with the disclosure being sought by the claimants from MGN (Various Claimants v MGN [2014] EWHC 3655 (Ch)). He ordered MGN to give “generic disclosure” in relation to phone hacking – that is documents going to the general practices of phone hacking at Mirror Group newspapers. Continue reading

Yesterday saw two important developments on the criminal prosecutions of former News of the World employees. First, it was disclosed that on Wednesday 5 November 2014, a former News of the World journalist (who cannot be named for legal reasons) had been found guilty of conspiracy to commit misconduct in public office. In April 2011 the News of the World (NOTW) admitted being responsible for intercepting the voicemails of many individuals using the services of a private investigator, Glenn Mulcaire, before his arrest in 2006. There had already been some civil actions seeking damages for misuse of private information and many more were to follow. The newspaper was shut down in July 2011. Continue reading
The press have come together to present a united front following revelations that police have been accessing journalists’ phone records under provisions in the Regulation of Investigatory Powers Act (RIPA). On 20 October 2014 The Times had an alarming front page story with the headline “Police use loophole to hack phones and email” [£]. It was said that the police were “hacking” into hundreds of people’s voicemails, text messages and emails, using a “loophole” in surveillance laws. The complaint was that, instead of obtaining a warrant from the Home Secretary, the police were “getting round the rules” – by obtaining a production order from a Judge. Continue reading
