There is no comprehensive public record of judgments handed down in the Kings Bench Division, Media and Communications List (“MAC List”) in 2023. The best available data appears to be from the invaluable Bailii website which lists 61 MAC List first instance judgments for 2023. This is a fuller list than Westlaw – which has 50 judgments, and the National Archives (Findlaw) which has 45. Continue reading
It has been announced that the President of the King’s Bench Division has appointed Mrs Justice Steyn DBE and Mrs Justice Collins Rice DBE as the Judges Jointly in Charge of the Media and Communications (MAC) List. This is a three year appointment that runs from 22 December 2023 to 21 December 2026. Continue reading

On 1 December 2023, Mr Justice Jay handed down judgement in favour of the defendant in the case of Dyson v MGN Limited [2023] EWHC 3092 (KB). The defendant published an article which characterised Sir James as “the vacuum cleaner tycoon who championed Vote Leave due to the economic opportunities…before moving his global head office to Singapore. In other words kids, talk the talk, then screw your country, and if anyone complains tell them to suck it up“. Continue reading
In his judgment in Davidoff v Google LLC ([2023] EWHC 1958 (KB)) Nicklin J has comprehensively restated the principles to be applied on Norwich Pharmacal applications, emphasising the importance of balancing the Convention rights of the applicant and those of the alleged wrongdoer. Continue reading
On Tuesday 21 November 2023, Counsel for the claimants in Lawrence & Ors v Associated Newspapers Ltd (ANL) told the High Court that they intend to ask ministers for permission to use confidential Leveson Inquiry documents in their legal action against the publisher of the Daily Mail. Earlier this month, Nicklin J ruled that the legal challenges could continue but could not use information drawn from ledgers given by ANL to the Leveson Inquiry into press standards in 2011 and 2012 [2023] EWHC 2789 (KB). The ICO is seeking permission to appeal the ruling on Clearview AI Inc handed down by the First Tier Tribunal (Information Rights) on 17 October 2023. The tribunal reversed the £7.5 million penalty notice issued by the ICO against the facial image database company on the basis that the UK GDPR did not apply to companies processing data as a service to foreign law enforcement agencies. The Commissioner argues that the FTT incorrectly interpreted the law, as Clearview itself was not processing data for the purpose of foreign law enforcement. Read the ICO’s statement here. On 10 November 2023, Nicklin J dismissed Associated Newspaper Ltd’s (ANL) application for summary judgement against seven claimants bringing misuse of private information proceedings against the publisher of The Daily Mail, The Mail on Sunday, and the MailOnline website, Baroness Lawrence of Clarendon & Ors v Associated Newspapers Ltd [2023] EWHC 2789 (KB). Nicklin J concluded “without difficulty” that each claimant had a real prospect of overcoming any limitation defence relied upon by the publisher. Continue reading
