Case Law, Strasbourg: Haldimann v Switzerland, Conviction for secret filming breached Article 10 – Hugh Tomlinson QC

kassensturz-emblemIn the case of Haldimann v Switzerland (Judgment of 24 February 2015, available only in French), the Second Section held that the conviction of four journalists for having recorded and broadcast an interview of a private insurance broker using a hidden camera was a breach of their Article 10 rights.  Although the case has been hailed as a “breakthrough for investigative journalism” it was, in reality, a fact sensitive decision from which no general conclusions can be drawn. Case Law, Canada: Baglow v Smith, defence of “fair comment” succeeds in landmark blogging libel case

free-dominion-libel-1024x843The long running and high profile “blogger defamation” case of Baglow v Smith has been determined in the defendant’s favour.  In a judgment handed down on 23 February 2015 ( [2015] ONSC 1175), the Ontario Superior Court of Justice held that the operators of a right wing message board were publishers of defamatory material concerning a left wing blogger.  However, the claim failed because defendants were entitled to rely on the defence of “fair comment”,  The case addressed, for the first time, a number of issues concerning “blogging and the law of defamation. Sun Four Trial: Prosecution Closing, jury reminded of Rebekah Brooks admission of payments to police officers

Summing up the prosecution case against four senior staff at the newspaper, an army officer and his wife Michel Parroy QC told an Old Bailey jury that the trail was “in the end about greed,” greed from the sources for money and greed from the Sun for stories. Mirror Damages Trial: Phone hacking was “rife” at MGN titles, court told [Updated2]

Mirror Hacking ClaimantsThe civil claim by eight representative claimants against MGN Ltd, publishers of the Daily Mirror, the Sunday Mirror and the People began today – after yesterday was devoted to preliminary legal argument. MGN has admitted liability in relation to each of the claimants and the main purpose of the trial is to establish damages guidelines for subsequent cases.
