BAI logoThe Broadcasting Authority of Ireland (BAI) is the body responsible for the regulation of broadcasting in Ireland, and two of its recent decisions raise the same question of whether a power provided to it by the Broadcasting Act, 2009 (also here) is consistent with the right to freedom of expression protected by the Irish Constitution and the European Convention on Human Rights. Case Law: Crow v Johnson, Libel action against London Mayor struck out

The leader of the RMT Union, Bob Crow, has failed in a libel claim against London Mayor Boris Johnson relating to leaflets issued the 2012 London Mayoral campaign.  In a judgment handed down on the day of the hearing  Mr Justice Tugendhat held that, in “the context of a hotly contested election” the words could not be held to be defamatory ([2012] EWHC 1982 (QB)).
